1. General

1.1 For purposes of these General Terms and Conditions and elsewhere on the website, “{Kid}GotStyle” is the trading name of Creative Smack Ideas (Proprietary) Limited, Reg nr: 2012/111836/07. {Kid}GotStyle’s head office is located at Ruimsig Manor 4, Unit Number 7, Van Dalen St North, 1724, SA; Email address:

2. Application

2.1 These General Terms and Conditions will apply to any and all agreements and legal relations pursuant to which {Kid}GotStyle acts as supplier of items. All visitors entering contests hosted by {Kid}GotStyle will fall under the same agreement.

2.2 To place an order with {Kid}GotStyle you are confirming that you are of the legal capacity to enter into a contract with {Kid}GotStyle (of the correct age, have authority to use the credit card etc.).

3. Product specifications; pricing; typographical errors

3.1 {Kid}GotStyle will not be required to execute an order or compensate a buyer for any loss if {Kid}GotStyle made an error when presenting the item, stating its price online, or formulating its characteristics. We hereby request that you please notify us immediately should you find any problems on any of our listed items, and

i) it should have been clear to the buyer that such involved a printing error; or
ii) if the buyer should not, under the circumstances, have reasonably relied on {Kid}GotStyle delivering quoted item, with stated characteristics, at this price.

4. Prices

4.1 Products sold by {Kid}GotStyle are billed in Rands and does not include VAT. (We are not required to register for VAT yet.) As soon as we have to register, VAT will be included in all the prices shown online.

5. Market

5.1 Items are currently delivered only to buyers in the Republic of South Africa. Purchase agreements are concluded with natural persons not acting in the course of a profession or business- only. Should you require items on a business level, please feel free to contact us directly. We do offer discount on larger orders.

6. Delivering the Items

6.1 All prices of the items posted on the website are exclusive of delivery costs.

6.2 Delivery costs will be stated separately when settling the order and may vary daily and for each order.

6.3 Free shipping applies to all carts with an excess of R500. Free shipping will be regulated by the same set of rules explained in 6.2. Free shipping will be done via courier on a next day basis.

6.4 It is the buyers responsibility to ensure that all details supplied to us are correct and continue to be accurate. Any costs that may arise out incorrect details will be for the Customer’s account.

7. Delivery Period

7.1 We do our best to ship all items within 24 hours of purchase. We cannot guarantee this statement as we rely on electricity and other factors to ensure that we meet the 24 hour deadline. Should we be subject to severe load shedding etc, the 24 hour deadline might be forced to 48 hours. We do however strive to bring our customers a delivered item within 48 hours of sale. Please note that ordering on a Thursday after 5pm, shipping will be moved to Monday. This may cause some delay in delivery. When registering, buyers must state a telephone number on which they can be reached during the day (such as their number at work or a mobile phone number), so that the delay, if any, will be as short as possible.

7.2 The delivery periods referred to above are of an indicative nature and are not times of the essence. Should the order not be delivered within 5 days for courier and 25 days for post, the buyer will be entitled to cancel the order at no charge.

7.3 {Kid}GotStyle shall arrange delivery by post or dispatch in any other way, at {Kid}GotStyle option. Note that a signature will be required for all residential deliveries. Most orders will be via Fastway Couriers, however, should the delivery be outside of the delivery scope, alternative methods may be used.

7.4 However very unlikely, {Kid}GotStyle may dispatch the delivery in parts. Any extra costs for subsequent deliveries will be borne by {Kid}GotStyle.

7.5 Items paid vie EFT may result in a 48 hour delay. We only ship items once the funds are cleared in our account. To prevent the delay, clients may use Payfast instant EFT. Depending on Banks, funds can take up to 48 hours to clear in our account. We will ship the item immediate upon clearing.

8. Returns / Refunds Policy

8.1 Products may be returned if the incorrect product has been supplied or the product is damaged or faulty. In such an instance {Kid}GotStyle will exchange the product on condition that

(i) the product is returned in its original condition and
(ii) the customer returns the product within five days of receipt and confirms same by sending a written notice to (within above mentioned five day period).
(iii) All returns must be shipped freight (and insurance) prepaid. The onus is on the customer to ensure that the goods returned are received by {Kid}GotStyle within 10 days of written notice. Under no circumstances will {Kid}GotStyle accept responsibility for goods returned that are lost in transit.

On receipt and acceptance of returned product {Kid}GotStyle will make all reasonable effort to exchange said product, but if replacement is not possible {Kid}GotStyle will refund the purchase price, including delivery cost. Such amount will be refunded within 30 days of cancellation; beginning on the day written notice was given.

8.2 All returns not related to damage, faults or the incorrect product supplied will be accepted on the same terms as explained in 8.1, however, the buyer will be responsible for the return shipping costs. The cost of the item will still be returned to the buyer once the item was received and in an acceptable condition.

8.3 Please inspect the product before signing for delivery. If you sign for a product on delivery you are agreeing that you are happy with the obvious condition of the product that you have received.

8.4 Custom items can only be returned if items are defective or damaged. Please ensure you order the correct size and style. {Kid}GotStyle reserves full rights to at our discretion refund any custom items.

9. Payment

9.1 Payment is accepted via credit card (Visa or Mastercard) and direct EFT transfer. Online credit card transactions will be acquired for {Kid}GotStyle via Payfast (Proprietary) Limited (“Payfast”). Payfast uses the strictest form of encryption namely Extended Validation SSL with 256-bit encryption. Only two of the four major South African banks use this, the highest, level of encryption currently available, and no credit card details are stored on the website. 3D Secure is in place for all credit card transactions. Users may go to their website ( to view their security certificate and security policy. Customer details will be stored by {Kid}GotStyle separately from card details which are entered by the client on Payfast’s secure site. {Kid}GotStyle scrutinises all transactions very carefully to prevent attempted fraud and a transaction may be refused if {Kid}GotStyle is not satisfied with its legitimacy.

9.2 All items paid vie EFT will only be shipped once the funds are cleared in our account.

10. Agreements of Sale

10.1 Placing an item in a shopping basket, without completing the purchase cycle, does not constitute an agreement of sale between {Kid}GotStyle and the purchaser. Users cannot hold {Kid}GotStyle liable if such items are not available when the purchase cycle is completed later; and/or constitute an order for such an item; and {Kid}GotStyle may remove such an item from the shopping basket if no stock is available. An agreement of sale between {Kid}GotStyle and a user only comes into effect if and when a credit card authorisation is received from the issuing bank, or a notification of payment was received for any EFT payments. {Kid}GotStyle reserves the right to refuse to accept and/or execute an order without giving any reasons. {Kid}GotStyle also reserves the right to cancel orders in whole or in part as circumstances dictate. {Kid}GotStyle shall only be liable to refund monies already paid by the user.

10.2 If you realize that you have made a mistake with your Order after you have completed the checkout process, please contact immediately.

11. Stock Availability

11.1 Stock on offer is limited. {Kid}GotStyle shall take all reasonable efforts to discontinue all services as soon as stock is no longer available. However, should items still be offered after stocks are sold, {Kid}GotStyle shall only be liable to refund monies where it is unable to fulfill orders.

12. Personal Data

12.1 {Kid}GotStyle shall take all reasonable steps to protect the personal information of Users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000.

12.2 {Kid}GotStyle will store the data provided by buyers in a data file. Such data will be used to execute buyers’ orders and will be kept as long as necessary to handle any complaints about the execution of an order. No data will be passed on to third parties if such should jeopardise the buyer’s privacy.

13. Applicable Law

13.1 This site is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African law.

14. Changes To Agreement

14.1 {Kid}GotStyle may, at its sole discretion, change this agreement or any part thereof at any time without prior notice.

15. Intellectual Property Rights

15.1 All the content, trademarks and data on this web site, including but not limited to, software, databases, text, graphics, icons, hyperlinks, private information, designs and agreements, are the property of or licensed to {Kid}GotStyle and as such are protected from infringement by local and international legislation and treaties.

16. Product Variations

16.1 All items are manufactured and printed by hand. Due to the nature of any hand-made products, some variations may occur. This includes but is not limited to color, layout, stitching, size of print etc. We do our best to ensure that every product sold is exactly as shown on our website, however, due to different screen settings, resolutions, brightness & contrast, some colors may vary slightly from the actual product.

16.2 Our products are made in Cape Town with only the highest quality 100% cotton. In extremely rare cases, fabrics may differ from one order to another. {Kid}GotStyle brand tags may be moved to accommodate design flow.

17. Contests

17. 1 From time to time we will run contests to promote our brand and interact with our customers. We reserve the right to amend contest rules at any time to suit our requirements. When contest rely on votes, we will use various methods to ensure vote legitimacy. If we as much as suspect or find a person manipulating votes, we reserve the right to remove the entrant as per our own discretion. We will remove the entrant without any explanation with immediate affect.

17. 2 We use “StatCounter” a third party database management system & Google Analytics to log every user that visits this site. We do not capture private information and do not save the logs. This purely helps us to determine if a voter is trying to manipulating the system. We do not save the reports and only capture 2 days at a time. As soon as we suspect foul play, we will investigate immediately. We manually audit the system to try and find what IP address violated the rules. If we find any irregularities, we reserve the right to remove the photo without any explanation. We do our best to ensure fair contests for all entrants.

17.3 In some cases, we will reasonably try and resolve the matter. This might require some assistance from the entrant. If at any point we feel that the system was manipulated, with or without evidence, we reserve the right to remove the entrant at our own discretion. If you do not agree, please do not enter any of our contests. If you play fair, you will have nothing to worry about. All contests are in good faith, we will not be liable for any damages caused by entering any of our contests.

18. Domicilium

18.1 {Kid}GotStyle chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature at Ruimsig Manor 4, Unit Number 7, Van Dalen Street North, 1724, South Africa.

19. Force Majeure

19.1 {Kid}GotStyle shall not be liable for any delay in performing any of its obligations under these Terms of Use if such delay is caused by circumstances beyond the reasonable control of {Kid}GotStyle, and {Kid}GotStyle shall be entitled to a reasonable extension of time for the performance of such obligations.
